Obama Sidesteps The Constitution…Again
January 4, 2012
The way Barack Obama sees a Democracy, its really a MONARCHY! That’s why President Obama has decided to make a “recess appointment” and place his own director in his own, newly-created federal agency…the Consumer Financial Protection Bureau. Richard Cordray,a former Attorney General from Ohio received the recess appointment which should have been approved by the Senate. What’s causing a stir, is that the Senate wasn’t in recess!
For months ” determined as ever to protect Wall Street and the big banks instead of you” say Democrats, Republicans stymied the agency from doing its job by filibustering Richard Cordray’s nomination. Why? Because Republicans opposed the creation of yet ANOTHER federal agency. Barack Obama on the other hand, obviously feels the more the merrier!
The battle is over power. President Obama wants this consumer protection agency in place for his re-election record, and he especially wants to be able to remind Ohio voters in 2012 that he picked one of their own to head it up!
The President’ LAST concern was whether he was following the Constitution. Check out what a Recess Appointment is…and YOU DECIDE!
“A recess appointment is the appointment, by the President of the United States, of a senior federal official while the U.S. Senate is in recess. The U.S. Constitution requires that the most senior federal officers must be confirmed by the Senate before assuming office, but while the Senate is in recess the President can act alone by making a recess appointment. To remain in effect a recess appointment must be approved by the Senate by the end of the next session of Congress, or the position becomes vacant again; in current practice this means that a recess appointment must be approved by roughly the end of the next calendar year. Recess appointments are authorized by Article II, Section 2 of the U.S. Constitution, which states:
“The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.”
Would have been perfect, if the Senate…wasn’t in session, and just a phone call away.
